Today in History

1927: The Jazz Singer opened today in 1927. Although the film was not the first 'talkie' picture it was a major landmark and ushered in an era of synchronised sound. Directed by Alan Crosland and staring Al Jolson, the movie made profits of $3.5 million at the box-office.

BAR supervisor admitted he "got it wrong"...

A bar supervisor yesterday admitted he "got it wrong" in the way he dealt with a colleague who died after drinking the equivalent of 17 pints of lager.

Stuart Foster, 27, had been working in the Cavendish nightclub in Tollcross, Edinburgh, in June 2004. He finished work about 1am but stayed in the club until 3am drinking.

Yesterday a fatal accident inquiry was shown CCTV footage of Mr Foster slumped on a table, having a leather coat put over his head for two minutes, having water poured over his head, falling off his chair and being carried to a car by two people.

Procurator-fiscal Lesley Thomson asked supervisor David Pennycook: "What sort of state was he in?" Mr Pennycook, 28, replied: "From the video, he'd had too many drinks."

She put it to him that he was responsible for the safety of customers and staff.

Mr Pennycook said he had only basic training in first aid. If anyone was ill he would have called for the club's first aider.

He admitted not thinking about Mr Foster's safety. "Did you just get it wrong?" asked the fiscal. "Yes, I got it wrong," he replied.

The inquiry continues.
